Bahamas: International Business Companies (Accounting Records) Order 2013

The Office of the Attorney General and the Ministry of Legal Affairs of the Bahamas, in the exercise of the powers conferred by section 67(5) of the International Business Companies Act, which states that a company shall keep such other records as the Minister may by order prescribe, has recently issued the International Business Companies (Accounting Records) Order 2013, which mandates as follows:
 

The Office of the Attorney General and the Ministry of Legal Affairs of the Bahamas, in the exercise of the powers conferred by section 67(5) of the International Business Companies Act, which states that a company shall keep such other records as the Minister may by order prescribe, has recently issued the International Business Companies (Accounting Records) Order 2013, which mandates as follows:
 

That every company shall maintain at its registered office a declaration stating that reliable accounting records are available through its Registered Agent. This declaration, issued by the Registered Agent, must be submitted to the Bahamian Register before January 1st of every year.
 

In compliance with the above, we shall be conducting a file review of all Bahamas companies which we currently service as Registered Agent with the purpose to update these companies’ files with the location where the accounting records are located and with a declaration confirming that such records are readily available upon the Registered Agent’s request. You shall be duly informed by our staff members which companies currently under your administration will require this information to update their files.
